Terms of Use

These terms of use apply to your use of Soma's website at www.so-mastudios.com and the Soma app (together, the "Platforms"). They are made between you and Soma Wellness Collective Limited, a company registered in England and Wales under company number 16565995, whose registered office is at 276 Abbeydale Road South, Sheffield, S17 3LN, trading as Soma Studios ("Soma", "we" or "us"). By using the Platforms, you agree to these terms of use.

1. Other terms that apply

1.1Our Terms and Conditions apply to any booking, Membership, Session Pass or Gift Voucher you buy, and our Liability Waiver applies to your participation in any class or activity. If there is any conflict between these terms of use and our Terms and Conditions, the Terms and Conditions apply.

1.2Our Privacy Policy explains how we collect and use your personal information, including through cookies. It is available at www.so-mastudios.com/privacy-policy.

1.3Our booking system and the Soma app are provided to us by bsport, a third-party software provider. Your use of them is also subject to bsport's own terms of use and privacy policy.

2. Your account

2.1You must be aged 18 or over to create an account.

2.2You must keep your login details private and must not share your account with anyone else. You are responsible for any activity on your account. If you think someone else has accessed your account, please tell us straight away.

2.3The information you give us must be accurate, and you must keep it up to date.

2.4We may suspend or close your account if you break these terms of use or our Terms and Conditions.

3. Using the Platforms

3.1You may use the Platforms only for lawful purposes and for your own personal, non-commercial use.

3.2You must not:

  1. (a)use the Platforms in any way that damages, disrupts or impairs them, or interferes with anyone else's use of them;
  2. (b)try to gain unauthorised access to the Platforms, the systems they run on or any account other than your own;
  3. (c)introduce any virus or other harmful code;
  4. (d)use any automated tool to access, copy or book through the Platforms;
  5. (e)create more than one account, or make bookings for anyone other than yourself; or
  6. (f)post or send anything through the Platforms that is unlawful, offensive or infringes anyone else's rights.

3.3We do not guarantee that the Platforms will always be available or uninterrupted. We may suspend, withdraw or change any part of them for business or operational reasons.

4. Content

4.1All content on the Platforms, including text, images, logos, video, class formats and the Soma name and brand marks, belongs to Soma or its licensors.

4.2You may view the content for your own personal use. You must not copy, reproduce, distribute or use it for any commercial purpose, or use it to teach classes or give instruction to others, without our written consent.

4.3Information on the Platforms is general information only. It is not medical advice and is not tailored to you. If you are unsure whether a class is suitable for you, please speak to your GP before booking.

4.4We aim to keep the information on the Platforms accurate and up to date, but it may change from time to time. The booking system shows the current timetable, prices and availability.

5. Links to other websites

The Platforms may contain links to other websites, including our social media. We are not responsible for the content of those websites or how they use your information.

6. Liability

6.1Nothing in these terms of use excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law, including your statutory rights as a consumer.

6.2Subject to clause 6.1, we will not be liable for:

  1. (a)any loss caused by the Platforms being unavailable;
  2. (b)any virus or damage to your device, data or software that we could not reasonably have prevented; or
  3. (c)any reliance on general information on the Platforms.

7. Changes to these terms of use

We may update these terms of use from time to time. The current version will always be available on the Platforms. If we make a significant change, we will tell you before it takes effect.

8. General

8.1If any part of these terms of use is found to be invalid or unenforceable, the rest will continue in full force.

8.2These terms of use are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts of Scotland or Northern Ireland.
